Terms of Use
Effective Date: 2nd October 2025
These Terms of Use (“Terms”) govern your access to and use of Skolarz’s website, mobile applications, API and related services (collectively, the “Platform”). By accessing or using the Platform you agree to be bound by these Terms and any other documents expressly referenced (e.g., Privacy Policy, Refund Policy). If you do not agree, do not use the Platform.
- Definitions
- “Skolarz”, “we”, “us”, “our” — Skolarz [Legal entity name, registered address].
- “User”, “you” — any person who accesses or uses the Platform.
- “Content” — text, images, multimedia, courses, reviews, data, and other materials made available on the Platform.
- “Personal Data / Personal Information” — any information relating to an identified or identifiable natural person.
- Eligibility
- You must be at least 18 years old (or the age of majority in your jurisdiction) to create an account. Minors may use the Platform only under parental / guardian supervision and with the guardian’s consent.
- Acceptance & Changes
- By using the Platform you accept these Terms. We may change these Terms from time to time — updated Terms will be posted with a revised “Last Updated” date. Continued use after posting constitutes acceptance of the changes.
- Account Registration & Security
- Some features require an account. You must provide accurate, complete information and keep it up-to-date. You are responsible for safeguarding credentials and for all activity that occurs via your account. Notify us immediately of any unauthorized use.
- Permitted Use & Prohibited Conduct
- You agree to use the Platform lawfully and ethically. Prohibited acts include (by way of example):
- infringing intellectual property rights;
- uploading malicious code (malware, viruses);
- using bots/scrapers without written permission;
- impersonation or providing false information;
- violating applicable laws (including export controls, sanction regimes).
We may suspend or terminate accounts for violations.
- Platform Content, Ownership & License
- All Platform content (design, trademarks, source code, course materials, text, images) is owned or licensed by Skolarz and protected by law.
- Subject to these Terms, Skolarz grants you a limited, non-exclusive, non-transferable license to access and use the Platform for personal, non-commercial purposes.
- You may not copy, modify, distribute, create derivative works, decompile or re-sell Platform content except as permitted in writing.
- User-Generated Content (UGC)
- You may submit UGC (reviews, questions, forum posts) subject to content rules. By submitting UGC you grant Skolarz a worldwide, royalty-free, perpetual, irrevocable licence to use, reproduce, adapt, publish, translate and display your UGC in connection with the Platform and business.
- You warrant that your UGC does not violate third-party rights, is lawful, and you have necessary consents (including for images of other people). We may remove or refuse UGC at our discretion.
- Payments, Fees, Refunds & Subscriptions
- Paid features are subject to the payment terms and pricing presented at the point of sale. By purchasing you authorize payment processing through our third-party payment processors.
- Subscription services automatically renew unless you cancel per our cancellation policy. Refunds, if allowed, will be processed according to our Refund Policy XXXXXXXXXX. Taxes and payment charges are your responsibility.
- Third-Party Services
- The Platform may link to or integrate with third-party services and content. We are not responsible for third-party products, services, or their privacy practices. Use of third-party services is at your risk and subject to their terms.
- Privacy, Personal Data & Data Protection (India & GDPR)
10.1 Overview
Your use of the Platform is subject to our Privacy Policy, which explains what Personal Data we collect and how we use it. This section highlights key legal compliance principles relevant to India’s IT & Data Protection framework and the EU General Data Protection Regulation (GDPR) where applicable.
10.2 Applicable Law & Scope
- India: Personal data processing carried out in India or involving Indian data subjects is governed by the Information Technology Act, 2000 and associated rules such as the Reasonable Security Practices & SPDI rules and the Intermediary Guidelines (as applicable). These rules require consent, reasonable security practices, limited retention and defined procedures for handling sensitive personal data.
- EU / GDPR: If Skolarz processes data of individuals in the EU or offers services to EU-residents, GDPR may apply extraterritorially — imposing controller/processor obligations, data subject rights, breach notification timelines, and potential fines. Key GDPR obligations include lawful basis for processing, data minimization, purpose limitation, transparency, and rights such as access, rectification, erasure, portability and objection. Breaches should be reported to the supervisory authority within 72 hours when feasible; fines can be significant (up to €20M or 4% of global turnover).
10.3 Our Commitments
- Lawful basis: we process Personal Data only where we have a lawful basis (user consent, contractual necessity, legitimate interest, legal obligation).
- Data Minimization & Retention: we collect only what we need and retain data only as necessary, in line with legal/regulatory requirements.
- Security: we implement reasonable technical and organizational measures to protect Personal Data. For sensitive categories we implement enhanced safeguards in accordance with Indian SPDI principles.
- Data Subject Rights: EU data subjects may exercise GDPR rights (access, rectification, erasure, restriction, portability, objection). Indian data subjects may request access/correction and may withdraw consent where consent is the basis. Requests can be made through the contact details listed below.
- Cross-border transfers: where data is transferred outside source jurisdictions (e.g., from EU or India to other countries), we will rely on lawful transfer mechanisms (e.g., adequacy decisions, Standard Contractual Clauses, or other safeguards) as required by law.
10.4 Data Breach Notification
- For GDPR-relevant processing we will notify the relevant supervisory authority of a personal data breach within 72 hours of becoming aware where required, and notify affected data subjects where required by law.

- Intermediary Liability & Takedown
- If you act as a content provider or if content is posted by third parties on the Platform, you acknowledge that certain legal frameworks (e.g., Indian Intermediary Guidelines) condition intermediary safe-harbour on following due-diligence and takedown procedures. We may remove content or block accounts to comply with applicable laws and court or government orders.
- Security & Reasonable Practices
- We follow industry-standard security practices, maintain access control, encryption where appropriate, and incident response capabilities. However, no system is perfectly secure; you share data at your own risk. We encourage secure password practices and using two-factor authentication where available.
- Intellectual Property Infringement Claims
- We respect IP rights. If you believe content infringes your copyright, contact our designated agent via the contact details below with a DMCA-style notice (or other notice as required by applicable law). We will respond and may remove content pending investigation.
- Disclaimers
- THE PLATFORM IS PROVIDED “AS IS” AND “AS AVAILABLE”. SKOLARZ DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING FITNESS FOR A PARTICULAR PURPOSE, MERCHANTABILITY, OR NON-INFRINGEMENT TO THE MAXIMUM EXTENT PERMITTED BY LAW.
- Limitation of Liability
- TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SKOLARZ AND ITS AFFILIATES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY ARISING FROM OR RELATING TO THESE TERMS OR THE PLATFORM SHALL NOT EXCEED THE AMOUNTS PAID BY YOU (IF ANY) TO SKOLARZ FOR THE SERVICE IN THE 6 MONTHS PRECEDING THE CLAIM.
- Indemnity
- You agree to indemnify, defend and hold harmless Skolarz, its officers, directors, employees and agents from claims arising from your use of the Platform, your breach of these Terms, or your violation of laws or third-party rights.
- Termination & Suspension
- We may suspend or terminate your access for breach of these Terms or for legal reasons. You may terminate by ceasing use and closing your account. Sections that by their nature should survive termination (e.g., IP, Indemnity, Limitation of Liability) will survive.

- Governing Law & Dispute Resolution
- These Terms are governed by the laws of India — State / Union Territory except where mandatory law provides otherwise. For disputes involving EU-resident data subjects, GDPR may impose additional obligations and rights enforceable in EU jurisdictions. Parties will try to resolve disputes amicably first; if unresolved, disputes will be subject to the exclusive jurisdiction of the courts of Skolarz legal entity incorporation address.
- Children’s Policy
- The Platform is not directed at children under 18 years. We do not knowingly collect Personal Data from children. If a parent believes we have collected such data, contact us and we will delete it in accordance with applicable law.
- Miscellaneous
- Entire Agreement: These Terms (and Privacy Policy, Refund Policy) constitute the entire agreement between you and Skolarz.
- Severability: If any provision is found invalid, other provisions remain in force.
- Assignment: You may not assign your rights under these Terms without consent. Skolarz may assign to an affiliate or successor.
